Your Estate Agent's Account

We attach to this law-byte your Estate Agent's account on the sale of your property. You will see that it is, or should be, addressed to you, but may be addressed 'care of' us. It is your bill.

Please check the bill. If you wish us to pay it, just tell us. We will normally and where possible, keep back enough from the proceeds of sale for this purpose. If you wish to discuss the amount of the bill, or anything else, with the agent, please do so soon so that the matter can be finalised.

Sometimes your agreement with your estate agent requires you to agree to ask us to pay the account from the proceeds of sale. That agreement is not binding on us. In any event, we will only act as you request.

You may ask us to send the account and balance to you for you to settle up direct with the estate agent. We will be happy to do so. If you do wish to deal with the account direct, we ask your permission to let the agent know as a matter of professional politeness.

We do not normally know the precise details of the contract or arrangement between yourself and the estate agent. We can only therefore ask you. It is in any event your choice as to how the bill is to be paid.

If you wish to discuss the effect or meaning of your Estate Agents' terms of acting, please let us have a copy of these for this purpose.

Important: Please note that our law-bytes are retained for archival purposes only. The law changes, and these notes are often, now, out of date. You must take direct advice on your own personal situation and the law as it currently stands.
All information on this site is in general and summary form only. The content of any page on this site may be out of date and or incomplete, and you should not not rely directly upon it. Take direct professional legal advice which reflects your own particular situation.
