![]() Signing Name-Change Deeds The signing of a change of name deeds poses a query. Should it be signed in the new name, or in the old name? Our deeds are drawn so that you sign in both names. By using both the new name and the old name, there can then be no confusion or doubt. Because a name is being changed, the signatures on any change of name deed, are unusual. When signing a deed to change your name, you sign using your full names, rather than the more usual use of initials plus last name. Thus I would sign 'David Lewis Swarbrick' rather than 'D L Swarbrick.' This applies to both the new name and the old name. As always with deeds, the signature should be witnessed. The witness should see the signing, but need not know the precise contents of the deed. However, since the purpose of the deed is to declare a change of name, there would seem to be no point in avoiding disclosure. The witness should be independent of you, and an adult. You will often need several copies of a change of name deed, to be lodged, for example with your bank and with other people with whom you do business. If you return the deed to us, fully executed, we will normally be happy to provide certified copies. Although there is no law against it, the deed declares an intention to change your name, and it does not make sense to continue to use the previous name. It should normally be phased out quickly. The deed should be dated when you execute it and make the change. As always, in cases of doubt, please do ring and ask. |
