The applicant attempted to patent the use of two known pharmaceuticals to treat the folowing: "battle fatigue, combat stress reaction, post-traumatic stress disorder in civilian and military emergency situations, neurological symptoms associated with chemical warfare and nausea associated with chemical or biological warfare." Held: The specification contained no information to support the claim that the products in question would have any effect on these ailments. Neuberger J upheld the Comptroller's rejection of the claim on the ground that it was not supported by the description.

The tribunal was asked whether an assignee of a trademark should be substituted in existing opposition proceedings for the assignor. The assignment had taken place after the proceedings had begun. Held: A tribunal has an inherent power to regulate its own proceedings. Pumfrey J: "Turning to the present case, I must first deal with the question whether the three-month time limit on oppositions was, as the hearing officer decided in this case, … being circumvented. In my judgment, it plainly is not. Once the proceedings are on foot the time limit has ceased to be relevant to those proceedings at all." After referring to Industrie Chimiche Italia Centrale, Pumfrey J continued: "The effect of a substitution is that the party substituted carries on the original proceedings. He does not, by reason of substitution, become entitled to plead, if the pleadings are over, or file evidence, if the evidence is in, otherwise than by making application in the same manner as the original opponent would be obliged to apply if it wished to be allowed to revisit the pleadings or the evidence. No question of circumventing any time limit arises. So I do not think that to permit substitution offends against the requirements of the Act requiring an opposition to be started within three months of publication."

(Cancellation Division) (year?) The proprietor, Multiple Marketing, distributed the applicant for revocation's products under the trade mark BE NATURAL. Held: The application had been made in bad faith: "Bad faith is a narrow legal concept in the CTMR system. Bad faith is the opposite of good faith, generally implying or involving, but not limited to, actual or constructive fraud, or a design to mislead or deceive another, or any other sinister motive. Conceptually, bad faith can be understood as a "dishonest intention". This means that bad faith may be interpreted as unfair practices involving lack of any honest intention on the part of the applicant of the CTM at the time of filing. Bad faith can be understood either as unfair practices involving lack of good faith on the part of the applicant towards the Office at the time of filing, or unfair practices based on acts infringing a third person's rights. There is bad faith not only in cases where the applicant intentionally submits wrong or misleading by insufficient information to the Office, but also in circumstances where he intends, through registration, to lay his hands on the trade mark of a third party with whom he had contractual or pre-contractual relations."

The applicant sought a European patent for a method of calculating and controlling pensions benefits. The claim was "1. A method of controlling a pension benefits program by administering at least one subscriber employer account on behalf of each subscriber employer's enrolled employees each of whom is to receive periodic benefits payments, said method comprising:
providing to a data processing means information from each said subscriber employer defining the number, earnings and ages of all enrolled employees of the said subscriber employer;
determining the average age of all enrolled employees by average age computing means;
determining the periodic cost of life insurance for all enrolled employees of said subscriber employer by life insurance cost computing means; and
estimating all administrative, legal, trustee, and government premium yearly expenses for said subscriber employer by administrative cost computing means; the method producing, in use, information defining each subscriber employer's periodic monetary contribution to a master trust, the face amount of a life insurance policy on each enrolled employee's life to be purchased from a life insurer and assigned to the master trust and to be maintained in full force and effect until the death of the said employee, and periodic benefits to be received by each enrolled employee upon death, disability or retirement." Held: A computer programmed to carry out the unpatentable method was not within the categories of Art.52(2) – the fact that it was a physical thing ("concrete") was enough to take the case out of Art.52(2). It was really a method of doing business. It also rejected the apparatus claim. It acknowledged the 'technical effect' test: "According to the case law of the boards of appeal the use of the term "invention" in Article 52(1) EPC in conjunction with the so-called "exclusion provisions" of Article 52(2) and (3) EPC, which mention subject-matter that "in particular shall not be regarded as inventions within the meaning of paragraph 1", is understood as implying a "requirement of technical character" or "technicality" which is to be fulfilled by an invention as claimed in order to be patentable. Thus an invention may be an invention within the meaning of Article 52(1) if for example a technical effect is achieved by the invention or if technical considerations are required to carry out the invention . . . Claim 1 of the main request is, apart from various computing means mentioned in that claim, directed to a "method for controlling a pension benefits program by administering at least one subscriber employer account". All the features of this claim are steps of processing and producing information having purely administrative, actuarial and/or financial character. Processing and producing such information are typical steps of business and economic methods.

Thus the invention as claimed does not go beyond a method of doing business as such and, therefore, is excluded from patentability under Article 52(2)(c) in combination with Article 52(3) EPC; the claim does not define an invention within the meaning of Article 52(1) EPC." and "The feature of using technical means for a purely non-technical purpose and/or for processing purely non-technical information does not necessarily confer technical character to any such individual steps of use or to the method as a whole: in fact, any activity in the non-technical branches of human culture involves physical entities and uses, to a greater or lesser extent, technical means. . . Methods only involving economic concepts and practices of doing business are not inventions within the meaning of Article 52(1) EPC.
A feature of a method which concerns the use of technical means for a purely non-technical purpose and/or for processing purely non-technical information does not necessarily confer a technical character to such a method."

A patent was granted for a product, produced by the bacterium streptomyces hygroscopicus, called rapamycin, which was useful to suppress transplant rejection. Because rapamycin was a known product at the priority date, it could not be patented: neither could its use as a treatment, because that would offend section 4(2) of the Patents Act 1977. The claim was for a specific type. Claims for infringement and cross claims for invalidity were heard. Held: The patent had been infringed and the allegation of insufficiency failed. The court refused to make a declaration of non-infringement as sought.

The claimant, an American company claimed in passing off against the defendant. It had come into the UK market and established a free service under the name. The defendant had operated a paid for service under the same name from some time before. Held: The claim should proceed, but an interim injunction was refused. In passing off, the words claimed to establish a reputation in the goods had to be more than descriptive. Words which might once have been distinctive could become descriptive by general usage, as had happened in this case. The common stock of language conception was becoming increasingly difficult to apply. Here the use of the word 'efax' had become descriptive. Any confusion or association between the two companies arose from the common meaning of the words and not from any reputation in the name belonging to the claimant.

The claimants owned a major brand mark used in the distribution of tea. The defendants operated in the sale of kitchen equipment. Whether a sign infringed a mark without due cause was to be resolved at trial by the judge on the facts. The infringer had to show that he had good cause for his use, and that was not discharged merely by demonstrating good faith. In this case however there was no evidence of any damage to the claimant's Mark's distinctive character or repute.

The dispute arose between parties to without prejudice communications or who had obtained documents from such persons and were commercially connected with them. Held: An implied agreement would bind them as parties or by reason of the source of the documents in their hands. The without prejudice communications were governed by an implied agreement that they will not be used in the current or any subsequent litigation between the same or related parties. It was not appropriate to leave the issue to the foreign court to decide on admissibility, and an injunction was granted against their use. "The present dispute arises between persons who either were parties to the original communications or have obtained the documents from persons who were such parties, and, to the extent that it be relevant, are commercially and corporately connected with such parties. If there was an implied agreement the persons before me are either bound by it as parties or must be taken to be subject to it by reason of the source of the documents in their hands. In my judgment it is very strongly arguable, and indeed probable, that the without prejudice communications are indeed governed by an implied agreement that they will not be used in the current or any subsequent litigation between the same or related parties . . It is correct in my judgment to regard the protection as extending to subsequent litigation because otherwise on the one hand the public policy recognised by Lord Griffiths and other judges and on the other hand the expectation of the parties would not be fulfilled but rather would be subverted. The position may perhaps be different in practice between two parties who are brought together for example by the circumstances of a road accident and may never have anything else to do with each other, but the holders of patents in related areas, whether or not they are to be regarded as competitors, may well, through themselves or their licensees, come up against each other in a number of different commercial circumstances giving rise, not only among the litigation-prone, to several different disputes over time, such that it cannot be assumed that one piece of litigation is the last there will ever be."

The registration of two trade marks ('Budweiser') with the identical names was against the Act since it would appear to encourage the very confusion the Act sought to avoid. Nevertheless, where there was genuine honest concurrent use, that use might justify registration. Clause 12 of the Act clearly envisaged honest concurrent use. Here the name Budweiser had been honestly applied historically for many years by more than one supplier. Held: Both appeals were dismissed. Peter Gibson LJ said: "there is a real tangible danger that to drop the name Budvar from Budweiser Budvar for BB's beer would be likely to increase the existing inevitable confusion of that beer with the more widely marketed and better known beer of AB. If one leaves section 12(2) aside, that is not something to be encouraged. I cannot accept that section 2, merely by preserving rights to sue in passing off, can convert what is otherwise an application objectionable because of the likelihood of deception and confusion into one which cannot be defeated by section 11. The section 11 test must be applied regardless of section 2. Subject to section 12(2) therefore, in my judgment the objection under section 11 is made out."

The court considered a dispute about ownership and confidence in and copyright of of video tapes taken by Princess Diana before her death. Held: The courts have an inherent discretion to refuse to enforce of copyright. When assessing whether the copyright should be enforced the relevant issues would be ones arising from the work itself, and not from the ownership. Copyright rights are assignable in law, and therefore the court must apply different tests to those which applied to the breach of confidence. Here photographs had been copied, sold and republished. Even if some degree of use would be fair dealing, excessive use can render the use unfair: " the basis of the defence of public interest in a breach of confidence action cannot be the same as the basis of such defence to an action for infringement of copyright. In an action for breach of confidence the foundation of the action can fall away if that is required in the public interest, but that can never happen in a copyright action. The jurisdiction to refuse to enforce copyright, which I believe has been recognised comes from the court's inherent jurisdiction. It is limited to cases where enforcement of the copyright would offend against the policy of the law. " . . . a court would be entitled to refuse to enforce copyright if the work is: (i) immoral, scandalous or contrary to family life; (ii) injurious to public life, public health and safety or the administration of justice; (iii) incites or encourages others to act in a way referred to in (ii)." On a case management hearing, the defendants made admissions on which judgment was entered. The master reserved but later awarded costs. The defendants appealed against the costs order saying that the claimants had proceeded unnecessarily aggressively and had failed to disclose evidence in a timely way. The appeal took effect as a rehearing. Intellectual property cases should be subject to the same overriding objectives as in other cases. In this case the order was correct. An appeal to a High Court judge against an order for costs, was a rehearing, and such a judge was free to exercise his discretion accordingly. Where however the issue related to something specifically within the knowledge of the first instance judge such as the proportionality of the costs to the matter in cause this was to be disturbed only rarely. That the award was made on what was essentially a case management conference should not make a difference of principle.

Parallel importers could not be prevented from so acting by Trade Mark law unless it could be shown that the activity caused substantial damage to the specific substance of the Mark. If damage was shown, the owner could complain unless it would operate to breach European law. A mark owner could object to the re-application of his mark by such importers only if he had not received notice of such activity. This was irrespective of proof of damage, but knowledge of the importer's activities constituted notice. The claimant appealed against an order striking out their threat action for trade mark infringement, in respect of the words 'No Tears' when used for children's shampoo. Held: The court had to consider both the letter and the surrounding circumstances. A threat need not be direct, and conditionality may not be an answer. The thrust of the letter was a warning of the possibility in the future of proceedings for infringement, with contingencies on success of other proceedings. The threat was veiled and muffled by protestations of continuing indecision (which did not ring true) but the threat was sufficient (if not designed) to unsettle the Claimants and the threat was of trade mark infringement proceedings in respect of sales within the United Kingdom.

The Act protects the privacy of a corporate body. A television company which secretly filmed in a company's store could be held to have infringed the privacy of the company by the Broadcasting Standards Commission. The Act went further than the Human Rights Convention in this respect, but there is no reason to limit the extent of the operation of the Act to match the convention. "An infringement of privacy is an affront to the personality, which is damaged both by the violation and by the demonstration that the personal space is not inviolate."
Lord Mustill said: "To my mind the privacy of a human being denotes at the same time the personal 'space' in which the individual is free to be itself, and also the carapace, or shell, or umbrella, or whatever other metaphor is preferred, which protects that space from intrusion. An infringement of privacy is an affront to the personality, which is damaged both by the violation and by the demonstration that the personal space is not inviolate."

The defendant had a cuttings service, and distributed selected articles amongst its staff. The Agency complained that this amounted to copying a substantial part of the editions from which the cuttings were taken. There was no typographical copyright infringed as the layout had changed, and the work referred to was the entire paper edition, and the question of what was a substantial part of the edition was a matter of impression. The statutory definition of a "published edition" meant that copyright could subsist in the typographical arrangement of the newspaper as a whole.

The reputation of a trade mark does not give grounds for presuming a likelihood of confusion simply because of a likelihood of association in the strict sense.
Europa Article 5(1)(b) of First Directive 89/104 on trade marks cannot be interpreted as meaning that where
- a trade mark has a particularly distinctive character, either per se or because of the reputation it enjoys with the public, and
- a third party, without the consent of the proprietor of the mark, uses, in the course of trade in goods or services which are identical with, or similar to, those for which the trade mark is registered, a sign which so closely corresponds to the mark as to give rise to the possibility of its being associated with that mark,
the exclusive right enjoyed by the proprietor entitles him to prevent the use of the sign by that third party if the distinctive character of the mark is such that the possibility of such association giving rise to confusion cannot be ruled out.
The reputation of a mark does not give grounds for presuming the existence of a likelihood of confusion simply because of the existence of a likelihood of association in the strict sense. A positive finding of the existence of a likelihood of confusion, which constitutes the matter to be proved, is necessary.

The invention was a second medical use for a known drug rapamycin, which was found to have an immuno-suppressive effect. The court asked whether a claim to rapamycin should be construed to include derivatives. Held: A person skilled in the art would be unable to say without experimentation that any particular derivative would have an immuno-suppressive effect. Applying the second Protocol question, it would have been absurd to ask whether, assuming that a derivative "worked" in the sense of having an immuno-suppressive effect, it worked "in the same way". That would really be to beg the question. Neither the product nor the process was new: the whole point of the invention was the newly discovered immuno-suppressive effect.

Courts must be careful when judging claims with hindsight, and where different national standards had been involved. A claim to amend a patent drafted in the US for grant in the European Patent Office by a German firm of patent agents without reference to UK practice. The claimant sought damages for copyright infringement in respect of two works which parodied a song to which they owned the rights. Held: The amount copied, being as much as a quarter of the original work, meant that the claim was indefensible. When considering the grant of an injunction "the right approach is to start with a strong bias in favour of granting an injunction, to be dispelled only if the circumstances of the case clearly make it unjust to do so." This was such an exceptional case. There had been acquiescence, and the claimants were interested only in the financial and not the artistic values. An injunction was refused and an enquiry as to damages ordered.

The claimant alleged that disparaging adverts by the defendant infringed its trade marks and amounted to the tort of malicious falsehood. Held: There was no dispute that the mark had been used. The architect drew plans for buildings on a development completion of which was taken over by the council. The architect claimed breach of copyright in his plans. The expression of design ideas in an architectural drawing was capable of protection by copyright. An architect might see the plans drawn by another, absorb some of the ideas, and then re-express the ideas in his own way. He may not copy them. The line between them is a fine one. Was the new design a copy of the style or idea or of the expression of the style or idea. One is acceptable, the other is not. The degree of similarity, and method of preparation of the second article were important.

Local authorities ran classes in which aerobics teachers used music for lessons. No licence was obtained for the performance of the music. They claimed to be "a club, society or other organisation the main objects of which were charitable or otherwise concerned with the advancement of religion, education or social welfare." In effect this was a claim that a local government was a charity. Held: The defence could not succeed. The functions of a local authority would not normally be considered charitable. In this context, ‘social welfare’ was an inappropriate expression to describe such activities. Similarly the term ‘organisation’ in the Act, in this particular phrase, was to be read ejusdem generis with the words ‘club’ and ‘society’. It could not apply to a local authority. The function of a local authority is to carry out the administrative and governmental functions, in respect of its area. The legislature had thought it right to devolve those functions from national government. Those functions might include social welfare, but that was not its main purpose.

The claimant sought to enforce its copyright in artwork for a fabric design Ixia, saying the defendant's design Marguerite infringed that copyright. Two issues faced the House. Just what had been copied and if any, then did this amount amount to the whole or a substantial part the design. Held: Where a court of first instance considered a claim of breach of copyright, it must consider both the question of whether copying had taken place, and if so whether what had been copied was substantial. An appellate court should recognise that both are questions of fact and degree, and should be very careful not to usurp the function of the court of first instance by reversing such a decision on appeal. Claims for infringement of artistic copyright differ from other infringement cases in that the result of infringement might or might not look like the original, and the fact of copying was more important. The line was very difficult to draw. Although in this case not the smallest part of a fabric design had been reproduced with anything approaching photographic fidelity, the copying of certain of the ideas expressed in that design which, in their conjoined expression, had involved original artistic skill and labour, constituted the copying of a substantial part of the artistic work.
Lord Hoffmann: "Generally speaking, in cases of artistic copyright, the more abstract and simple the copied idea, the less likely it is to constitute a substantial part. Originality, in the sense of the contribution of the author's skill and labour, tends to lie in the detail with which the basic idea is presented. Copyright law protects foxes better than hedgehogs. "

In the course of a challenge to a patent, the patentee sought to amend the patent. Held: He was not obliged when doing so to disclose documents in a manner which would allow their use on a wider basis than for the consideration of the amendment application. Revealing such documents beyond what was required to show the good faith of the assertion of privilege would lead to the loss of that privilege abroad. There was no obligation in modern litigation on a patentee to waive privilege in respect of all such documents. The decision whether to waive privilege was the patentee's, and the court's job was then to decide whether in fact privilege is waived.

po The proprietor (Matelect) was the original applicant for the EP patent, but had assigned the rights to another company during the application process. Some time after grant, the rights were re-assigned to Matelect and the patent agent who dealt with the re-assignment promised to send them a reminder regarding the next renewal fee payment. The agent did not do so explicitly, but nevertheless wrote to Matelect issuing a general reminder that renewal fees are payable annually. The agent also asked if he should inform the Office of a change in the address for service. On receiving no reply, the agent wrote another three times to Matelect asking whether renewal fees should be paid and if he was to be the address for service. Although Matelect replied concerning other matters in these letters, no instructions were received regarding address for service or
The Office’s standard warning letter about overdue renewal fees was therefore not received by Matelect or their agents. Despite the letters from their agent asking for instructions, Matelect had assumed that they would in any case receive the promised reminder from their agent. This was held not to be taking reasonable care in giving instructions and making arrangements for renewing the patent and so the patent was not restored.

Where a trader was involved in an activity quite outside any activity which might be undertaken by the holder of the registered trade mark, and there was no real likelihood of confusion, the owner of the mark could not claim that the value of his own mark would be diminished or damaged caused to its reputation by the additional use. The first two claimants sold exclusive rights to photograph their wedding to the third claimant. A paparrazzi infiltrated the wedding and then sold his unauthorised photographs to the defendants, who now appealed injunctions restraining them from publishing them. Held. Interlocutory injunctions restraining publication of the unauthorised photographs were lifted. A right of privacy could be derived from the equitable doctrine of confidence. The Act required respect to be given to respect for private and family life. Particular regard could be had to relevant codes of practice and conduct. In this case the Press Complaints Commission's code applied. The new law required a remedy not just for those whose trust had been abused, but also for those whose privacy had been invaded. Sedley LJ said: "We have reached a point at which it can be said with confidence that the law recognises and will appropriately protect a right of personal privacy."
