The appellant had offended while on licence from a life sentence for murder. When sentencing the trial judge took into account the fact that he posed a moderate risk of future violence to women with whom he had had an intimate relationship. The length of the sentence was held to be excessive on appeal by the High Court of Justiciary, but the judge's approach to the matter was approved: "Although a court will be aware that a particular offender has been recalled by the Secretary of State, who will need to bear in mind the safety of the public in considering his future release from custody under the life sentence, the duty of the court in sentencing him for the particular offence of which he has been convicted is to approach the matter in the usual way. The court will therefore chose the sentence which is appropriate, having regard to the nature of the offence, the previous convictions of the offender and all the other factors which a judge normally takes into account. Among those factors may be the need to choose a period which the court considers will give the public appropriate protection from any risk of reoffending."

(Scotland) The pursuer had no pre-existing degenerative condition of his lower spine, although he had degenerative changes in his cervical spine. As a result of an accident he sustained a prolapsed inter vertebral disc in his lumbar spine as a result of which he required a discectomy, and he also sustained an injury to his neck which precipitated symptoms of pain and restriction of movement. Held: The English decision in Wells v Wells on the calculation of lump sums to be awarded for future care and loss of earnings is to be applied in Scotland. It had included consideration of a Scottish case which previously applied.

A company procuring insurance purchases for credit card protection was as exempt from VAT as was the insurer. A provision which restricted the ability to claim such exemption to those registered as insurers under national was invalid under European Law: "… it is for the national court to determine … whether the transactions … are to be regarded for VAT purposes as comprising two independent supplies … or whether one of those two supplies is the principal supply to which the other is ancillary, so that it receives the same tax treatment as the principal supply." What matters is "the essential features of the transaction". "There is a single supply in particular in cases where one or more elements are to be regarded as constituting the principal service, whilst one or more elements are to be regarded, by contrast, as ancillary services which share the tax treatment of the principal service. The pursuer and his passengers were injured when he drove off a bridge which had been damaged in a severe rainstorm. He claimed in negligence against the police, who had been informed of the collapse of the bridge, but had not erected any warning signs. As a result, a car fell into the river, killing two people and injuring a third. Held: Lord Hamilton rejected a submission that, by reference to Hill, there was “no general duty of care owed by the police towards private individuals”. His Lordship said: "there is no close analogy, in my view, as regards the policy issue between the exercise by the police of their function of investigating and suppressing crime and the exercise by them of their function of performing civil operational tasks concerned with human safety on the public roads. It was not disputed that the police enjoy no immunity on public policy grounds in respect of the manner in which a constable drives his police vehicle or his motor cycle on the public roads. There would likewise be no immunity, in my view, in respect of the manner in which a constable in charge of directing traffic on such a road performed that function. Likewise, there is no immunity, in my view, in respect of the manner in which other civil road safety operational tasks are carried out by police officers where there is no inherent problem of conflict with instructions issued by superior officers or with duties owed to other persons.
Lord Hamilton later commented on what he called “a tide in the English courts” towards a wide interpretation of what had been said in Hill, which he suggested “may now be running less strongly”. He continued: "Moreover, the decision of the Court of Human Rights in Osman v United Kingdom [[1998] ECHR 101], together with the position adopted by the UK Government before that court that ‘the exclusion was not a blanket exclusion of liability but a carefully and narrowly focused limitation which applied only in respect of the investigation and suppression of crime, and even then not in every case’, may also lead to some reconsideration of the scope of the public policy immunity accorded to the police in some of the English decisions."

The appellant pleaded guilty to an assault with a knife upon a stranger. He had a previous conviction for assault causing severe injury and permanent disfigurement, and two previous convictions for inter alia attempted murder and assault. He had committed the offence libelled while on licence from a sentence imposed for an offence that he had committed while also on licence. He appealed his sentence of life imprisonment with a fixed minimum under the Act of 7 years. The assault on the complainer in this case fitted into a pattern of aggressive behaviour when the appellant was drunk. Held: The purpose of the Act is to determine the punitive period which the prisoner must serve. After that period is over, the prisoner's detention on the ground of the protection of the public must be reviewed by an independent body. The appropriate determinate sentence, ignoring the element of protection of the public, would be six years and the minimum period required to be served as punishment before he could be released on licence would have been three years. In the absence of any particular circumstances indicating that a longer period should have been selected, the appropriate period for the sentencing judge to designate would have been three years.

The pursuers raised freshwater salmon (smolt) to the age of two before selling them on. An oil spill prevented them trading. When applying the test within the section, there is a need for the alleged discriminator to show that it was reasonable in all the circumstances of the case for him to hold the opinion in question: 'In my opinion, that part of the test requires an objective assessment of all the relevant circumstances. But that, of course, raises a question as to what circumstances are relevant for this purpose; and in particular it raises the question of whether a person in the defender's position is under some sort of obligation to make inquiries of a disabled person before forming any opinion. In considering this aspect of the case, it may be helpful at the outset to make clear that 'the relevant circumstances' do not extend to include all of the facts which may be established at a much later stage, for example during proof in a litigation. Counsel for the pursuer did not suggest that the reasonableness of an opinion should be tested, ex post facto as it were, by objective reference to all of the facts which might come to light at a later stage, and I am of opinion that counsel was correct to adopt that position. However, as I have noted earlier, he founded strongly on the submission that the defender should have engaged in dialogue with the pursuer so as to obtain more relevant facts than were immediately available to him. The submission bore, of course, to be founded on the Code of Practice, and in particular on the passage which I have already quoted from paragraph 1.7. In my opinion, counsel's submission on this point is crucial if the pursuer is to succeed because, like the sheriff, I consider that the opinion reached by the defender, on the facts as then known to him, was a reasonable one for him to reach. … 37 The question then is whether the defender should have endeavoured to obtain more information before finalising his opinion. The Act itself does not impose any such duty, but I accept that the Code contains a suggestion that some inquiry may be desirable. In my opinion, however, the need for further inquiry will depend very much on the facts and circumstances of a particular case. …'

One of the issues was whether Mr Macari had been entitled to refuse to carry out the instructions of the managing director because the club were in breach of another obligation to him under the contract between the parties. Held. In the context of the employer/employee contract, the implied obligation of trust and confidence to be found in that relationship fell to be seen as striking at the very root of the contractual relationship between the parties and that all the other obligations in the contract could be seen as the counterpart of that obligation.
Lord Caplan said: "The retention of performance must be directed at a failure on the part of the other party to perform a counterpart obligation. Moreover for retention to be available there must be a continuing failure to perform the counterpart obligation. No retention arises in respect of a past breach of contract by the other party."
Lord President Rodger said: "This authoritative gloss by Lord Jauncey confirms that the law does not regard each and every obligation by one party as being necessarily and invariably the counterpart of every obligation by others. One has to have regard to the circumstances. Lord Jauncey deduces from this that a material breach by one party of a particular term of a contract does not of itself mean that he cannot require the other to perform any of his obligations under his contract. Rather, the party in breach cannot insist on the other party performing his obligations in relation to the part of the contract of which the first party is in breach."

The defendant appealed his conviction for indecent assault. He challenged the use of evidence of distress as corroboration of an allegation that violence had been threatened or used. Held: The appeal failed. There was no reason to distinguish between acts of rape and of indecent assault on the issue of the weight of such evidence: 'we see no reason whatever why the evidence in question should not corroborate the evidence of the present complainer as to her lack of consent to the appellant's conduct and the use of force by him in exactly the same way as such evidence is used in cases of rape. ' The Sherriff had not been applying the case of Stob which had since been overruled.

The pursuer, a nurse, claimed that she suffered psychological injuries as a result of her treatment at work by two superiors. Held: The court could find nothing in the pleadings: "which, if proved, could establish that Andrews and Henning ought to have foreseen that the pursuer was under a material risk of sustaining a psychiatric disorder in consequence of their behaviour towards her. They might have foreseen that she would at times be unsatisfied, frustrated, embarrassed and upset, but that is a far cry from suffering a psychiatric disorder. Many if not all employees are liable to suffer those emotions, and others mentioned in the present case such as stress, anxiety, loss of confidence and low mood. To suffer such emotions from time to time, not least because of problems at work, is a normal part of human experience. It is only if they are liable to be suffered to such a pathological degree as to constitute a psychiatric disorder that a duty of care to protect against them can arise; and that is not a reasonably foreseeable occurrence (reasonably foreseeable, that is to say by an ordinary bystander rather than by a psychiatrist) unless there is some specific reason to foresee it in a particular case."

The defendants appealed against sentence. The first and second were youths who had been convicted of a vicious and homophobic murder, and had been sentenced to be detained without limit of time. The third had also been convicted of a savage and brutal murder committed whilst a youth, and had received a sentence under the 1989 Act in the same terms. There was no provision for the possibility of release after a specified time. The Lord Justice General had certified the times to be served. They argued that the sentences included an element of deterrence, which had not been allowed for under the Act. Held: there had been an extension of the system for reviewing the sentences of discretionary life prisoners, whose sentences had already been imposed before the Act and who had been under 18 at the time. Their Lordships set out the procedures under the 1997 Act. The same list of considerations applied as would apply when the court considered the sentence in the first place, including anything which might have been put forward by way of mitigation or aggravation. Discretionary life sentences were imposed just because the court was concerned at the need to protect the public. It includes an element to reflect the crime and a part to protect the public. The Act intended to fix the first part after the event so that the need to protect the public could be tested before the parole board. The O'Neill case was not a good guide for dealing with discretionary sentences. One minimum period was adjusted, the others remained.

When reviewing a decision applying European law, that procedure was the same as for testing a decision made under English law. There is no provision for the examination of factual basis of the decision. When assessing whether a licence was to be granted for the shooting of a protected species, the test for such a licence was the protection of crops. The view of whether the survival of the species was threatened was to be looked at in the light of the entire population,. Not just that at the license site.

Despite a vasectomy, Mr MacFarlane fathered a child, and he and his wife sought damages for the cost of care and otherwise. He appealed a rejection of his claim. Held: The doctor undertakes a duty of care in regard to the prevention of pregnancy: it does not follow that the duty includes also avoiding the costs of rearing the child if born and accepted into the family. This is not the result of a public policy rule which would otherwise produce a different conclusion; it comes from the inherent limitation of the liability relied on. The claim for solatium stood, and the claim for expenses caused directly and immediately by the pregnancy and birth, including medical expenses (if any) and the costs of the layette, but the claim for damages in respect of the rearing of the child is dismissed. Lord Steyn: "It may be objected that the House must act like a court of law and not like a court of morals. That would only be partly right. The court must apply positive law. But a judge’s sense of the moral answer to a question, or the justice of the case, has been one of the great shaping forces of the common law. What may count in a situation of difficulty and uncertainty is not the subjective view of the judge but what he reasonably believes that the ordinary citizen would regard as right."

The system in Scotland whereby lesser judges were appointed by the executive, for a year at a time, and could be discharged without explanation or challenge, meant that they could be seen not to be independent, and the system was a breach of the right to a fair trial by an independent judiciary. There was no open protocol for making such decisions. Unconscious fears of influence in a judge's mind could be enough.
Lord Prosser referred to the temporary nature of the appointment of Sherriffs: "But I am inclined to see independence – the need for a judge not to be dependent on others – as an additional substantive requirement, rather than simply a means of achieving impartiality or a perception of impartiality. Independence will guarantee not only that the judge is disinterested in relation to the parties and the cause, but also that in fulfilling his judicial function, generally as well as individual cases, he is and can be seen to be free of links with others (whether in the executive, or indeed the judiciary, or in outside life) which might, or might be thought to, affect his assessment of the matters entrusted to him."

The court considered whether the criminal complaint that the defendants had been part of a conspiracy to set a bomb aboard an airliner which exploded over Scotland, was justiciable in Scotland. Lord Sutherland: "Where however, a crime of the utmost gravity has been in fact committed in a particular country and it can be shown that that crime is the culmination of a long drawn out and complex conspiracy, it appears to me quite illogical to say that that country has no interest in putting the conspirators on trial for their part in what has happened, even though their activities were all carried out abroad. Defence counsel recognise that this is undoubtedly so in relation to the charge of murder in Scotland. I see no logical reason why the same principle should not apply to the charge of conspiring to commit the final criminal act, which is alleged to be the culmination and the whole purpose of the conspiracy."

Where a contract specifically provided that it would become unenforceable after two years from the date of the contract, an action for breach of contract, and not just an action for performance of it, was also time barred after the expiry of the agreed time. This applied even if, as in this case, the breach occurred within the two year period. The word 'enforceable' should not be given such a constrained meaning as to limit it to an action for performance.

The appellants challenged convictions under regulations imposing toll charges. They challenged the validity of the charges. Held: The first challenge was that the people collecting the charges had not been properly appointed, being private contractors. The regulations had been complied with. Second the orders themselves were said not to have been published as required, having been incorrectly classified as local instruments. They were properly classified as local and did not have to be printed by the Queen's printer and made available for sale.

The appellant had been convicted of murder. He had given details of an alibi, but it appeared this might not have been fully investigated, in satisfying the duty imposed on the prosecutor by section 36. The status of the section was questioned. Held: The section imposed no duty on the prosecutor to communicate the results of his investigation, and no sanction for breach of it. The prosecutor should not be required to lead evidence that he had complied with the section.
