My Wife and I have never received a penny in Child maintenance from my Wife's ex partner. My Step Daughter is 17 and her Father has always been clever with somehow avoiding the CSA. His Parents are very wealthy and one day he is set to inherit in excess of a million sterling. What we want to know is whether we can claim for the 18 years of maintenance that we never received ?

My Step Daughter also feels that she should receive assistance from him whilst she is doing her A-Levels and when she goes to University ?

Was there a court order for child maintenance? If not, then (I'm guessing here) that it would be difficult to recover any monies. I'm sure someone else will be along with better help.

There has never been a court order for child maintenance ?

Is it something that can still be done to ensure my Step Daughter receives assistance with University fees ?

I think you need to point the CSA in his direction and to give all information that you have. Did you not say that the father lives in France?

The CSA will only backdate if you have made a claim through them previously, and any money recovered will be to the date of the first claim if I recall correctly.

I have harassed the CSA for years and have always been told that he does not need to pay as a result of being on welfare.

Obviously it will most likely be totally different if he's in France but I know if someone's on JSA, IS, DLA etc and living here, then £5 a week gets taken out of their award. But then as I say that bit of info is as useful to you as a chocolate teapot if he's in France. Sorry

Please don't take this the wrong way but I dont understand why you would want to claim child maintenance now, I thought you were emigrating?.

I am not a legal bod and so do not know the answer to your question but seems to me that the only reason you wish to claim child maintenance now is in anger.

I am of the opinion that a relationship should not be about money, your daughter does not want to know her father but is quite happy to take his money :? Very sad :(
