Bedroom Tax - Legislation

Bedroom Tax - Legislation

Postby Pamela » Tue Feb 19, 2013 11:50 pm

Breaches the European convention on Human Rights under sections 1, 3, 4, 8, 11, and 14. It also breaches Articles 4, 19 and 28 of the UN Convention on the Rights of Persons with Disabilities. In addition it is contrary to protections under the Equality Act and is contrary to decisions and judicial opinion (which set precedent)in the Burnip case.

Does anyone know if this is true as this kind of thing is over my hear re European Convention etc.

It might do. It might not do. You would never know until a court decided on the matter. The government obviously don't think so or they wouldn't be planning to put this into law.

Note also that the Minister putting the legislation before the House must make a statement that it is compliant with EU law.

This is as good a place to start as any - http://en.wikipedia.org/wiki/European_C ... man_Rights
