Harrassment

Postby I_Will_Ask » Tue Nov 13, 2012 5:50 pm

My girlfriend and I recently split, for reasons I won’t go into, and it was not amicable. I have text here exactly what I think of her on numerous occasions just to get the anger and frustration out of me. Some texts she replies to, of course denying stuff, but most don’t receive a reply.

She has so far not told me to stop texting, but when I went through them even I was shocked at the amount I’ve sent. Now I'm wondering if my texts would be classed as harassment even though she has not told me to stop sending them.

Yes I have stopped now, but the damage is done.

Yes, they might.
It does not matter that she has not asked you to stop, only that you know that she might feel harassed by them.
The cure for boredom is curiosity. There is no cure for curiosity.

You have stopped. Keep it that way.

The damage is as you say, done, but as each day goes by wit hyou not repeating it, it diminishes. Keep it that way.

The offence of "harassment" is contrary to the Protection from Harassment Act 1997 which makes it an offence to undertake a course of conduct which, on two or more occasions, causes alarm or distress to another.

There is a defence which amounts to an honest held belief that the course of conduct was reasonable and not causing such harassment, but it is fraught with difficulty.

By your own admission this would be unlikely to apply. It would be best to desist from further contact.
If you think it, don't say it.....If you say it, don't write it
If you write it, don't sign it......If you sign it......don't be surprised
